The Constitution of the Russian Federation establishes the right of everyone to compensation for damages caused to ones health or property by ecological violations. In accordance with the provisions of the Federal Law «On Environmental Protection» the legal and natural persons, causing damage to the environment, are obliged to reimburse it in full. Application of the above legal rules and compensation for damages, caused by an environmental tort, are considered in the course of extensive court proceedings, especially arbitration courts. It is noted that the legal aspects of solving these issues require revision of existing legislation. The article presents an analysis of the current legislation and its practical application. Suggestions to improve the legislation in the field of environmental torts are made.
